Terms of Service

1. Acceptance of Terms

By accessing or using MyFi ("the Service"), operated by MyFi ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use the Service. By creating an account, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

3. Description of Service

MyFi is a personal finance dashboard that connects to your financial institution accounts through Plaid to retrieve and display transaction data. The Service provides read-only access to your financial accounts — we cannot initiate transfers, payments, or any modifications to your accounts. Your financial data is stored locally on your device and is not retained on our servers.

4. Account & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We are not liable for any loss or damage arising from your failure to protect your account credentials or your device.

5. Credits & Payments

MyFi operates on a pay-as-you-go credit model. You purchase credits in advance, and each data sync deducts a small amount from your balance. All credit purchases are processed by Stripe and are final and non-refundable, except where required by applicable law. We reserve the right to change pricing at any time; any changes will apply only to future purchases and will not affect credits already purchased. Unused credits do not expire.

6. Local Data Storage

Your financial data — including transactions, balances, and account details — is stored locally on your device. Our servers act as a pass-through to Plaid and do not retain your financial data.

Because your data resides on your device, you are solely responsible for:

  • Backing up your locally stored data — we cannot recover data lost due to device failure, browser data clearing, or any other cause.
  • Securing your device with up-to-date software, strong passwords, and appropriate access controls.
  • Any consequences arising from unauthorized access to your device.

7. Third-Party Services

The Service relies on third-party providers including Plaid (for financial data retrieval) and Stripe (for payment processing). Your use of these services is subject to their respective terms and privacy policies. We do not control and are not responsible for the availability, accuracy, or conduct of any third-party service. We are not liable for any errors, outages, data inaccuracies, or losses caused by third-party providers.

8. No Financial Advice

MyFi is an informational tool only and does not provide financial, investment, tax, or legal advice. The data displayed by the Service is retrieved from your financial institutions and may contain errors, delays, or inaccuracies. You should not rely solely on MyFi for any financial decision. Always verify information directly with your financial institution and consult a qualified professional for financial advice.

9. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, software, and design — are owned by MyFi or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

10. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to any part of the Service, other users' accounts, or any systems or networks connected to the Service.
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
  • Use automated means (bots, scrapers, or similar) to access the Service without our prior written permission.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Misrepresent your identity or provide false information.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability.

We do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the data retrieved from your financial institutions will be accurate, complete, or current; (c) any errors in the Service will be corrected; or (d) the Service will meet your specific requirements.

12. Limitation of Liability

To the fullest extent permitted by applicable law, MyFi and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.

In no event shall our total aggregate liability to you for all claims arising out of or relating to the Service exceed the amount you have paid to MyFi in the twelve (12) months preceding the event giving rise to the claim, or $50.00, whichever is greater.

This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify, defend, and hold harmless MyFi and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any claim that your use of the Service caused damage to a third party.

14. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the state of the Service operator's principal place of business or remotely at the claimant's election.

You and MyFi agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination: (a) your license to use the Service immediately ceases; (b) any remaining credits in your account are forfeited, except where prohibited by applicable law; and (c) provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 11, 12, 13, 14, and 18.

16. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

17. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power outages, internet or telecommunications failures, or third-party service outages (including Plaid or Stripe).

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. To the extent that arbitration does not apply, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyFi regarding your use of the Service and supersede all prior agreements, representations, and understandings. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
